These Terms and Conditions (“Terms”) govern your access to and use of the website, web application, and services provided by Vozapy (“Vozapy,” “we,” “us,” or “our”). By accessing or using Vozapy, you agree to be bound by these Terms and by our other policies referenced here (including our Privacy Policy). If you do not agree, you must not use the Service. The Service is intended for users who can form a binding contract under applicable law.
Vozapy provides cloud-based audio tools, including but not limited to: (a) AI text-to-speech generation, (b) AI voice cloning, and (c) audio source separation (e.g. separating vocals from music) (collectively, the “Service”). We may update, modify, or discontinue any feature at any time, with or without notice.
You may be required to create an account to use some features. You agree to provide accurate, current, and complete information and to keep your credentials secure. You are responsible for all activity that occurs under your account.
“User Content” means any text, audio, voice samples, music, sound, files, or other materials you upload, submit, or generate through the Service.
You represent and warrant that you have all necessary rights, permissions, and consents to upload or provide User Content, including any voice you submit for cloning, and that your use will not infringe or violate any third-party rights (publicity, privacy, copyright, or similar).
You are solely responsible for the User Content you provide and for any output generated from it.
You must not submit content that is illegal, defamatory, hateful, deceptive, or that violates another person’s voice, likeness, or intellectual property.
Because Vozapy allows voice cloning and realistic AI audio, you agree to:
Clone only voices you own or are authorized to use. You must not clone the voice of another person, celebrity, brand, or entity without documented permission.
Avoid impersonation and deception. You must not use cloned or AI-generated voices to mislead, defraud, or impersonate a real person, or to create deepfakes for harmful or illegal purposes.
Comply with all applicable laws (including U.S. federal and state laws on privacy, publicity, and intellectual property).
Disclose AI use where required. If you publish or distribute content that could be mistaken for human-recorded audio, you agree to follow any disclosure rules that apply in your jurisdiction.
We may suspend or terminate accounts engaged in misuse.
To operate and improve the Service, you grant Vozapy a limited, worldwide, non-exclusive, royalty-free license to host, process, store, transmit, and display your User Content and generated output solely for the purpose of providing the Service to you, maintaining its security, and (in anonymized/aggregated form) improving our models and features. If you do not want your data used to improve the Service, contact us using the information below to see available options. (Some AI services adopt a broader license; we are keeping this limited here, but you can widen it if your business model needs it.)
You agree not to:
use the Service for any unlawful purpose;
upload or generate content that infringes third-party IP or privacy rights;
attempt to reverse engineer, scrape, or bulk-download voices, models, or datasets;
bypass security or rate limits;
use the Service to create harmful, harassing, or fraudulent audio;
resell or sublicense access to the Service without our written consent.
The Service, including all software, UI, branding, models, and documentation, is owned by Vozapy or its licensors and is protected by U.S. and international IP laws. You receive a limited, non-transferable, revocable license to access and use the Service for your internal/business purposes, subject to these Terms. You may not copy, modify, distribute, or create derivative works from the Service. All rights not expressly granted are reserved.
If the Service includes paid plans:
You agree to pay all fees described at the time of purchase.
Fees are non-refundable unless required by law.
We may change prices or plan features; changes will apply to the next billing cycle.
You are responsible for any taxes that apply.
The Service may integrate with third-party storage, payment, or AI providers. We are not responsible for third-party services and your use of them is subject to their terms.
We respect intellectual property rights and will respond to valid Digital Millennium Copyright Act (“DMCA”) notices. If you believe content on the Service infringes your copyright, please send us a notice with: (a) your contact details, (b) identification of the copyrighted work, (c) identification of the infringing material, (d) a statement of good faith, and (e) your signature. We may remove or disable content and, in appropriate circumstances, terminate repeat infringers.
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and share information. By using the Service, you consent to those practices.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, VOZAPY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT GENERATED AUDIO WILL BE FREE FROM ARTIFACTS OR SUITABLE FOR YOUR SPECIFIC USE CASE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOZAPY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE 3 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify, defend, and hold harmless Vozapy from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your use of the Service, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any third-party right, including use of someone else’s voice without permission.
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you violated these Terms, engaged in fraudulent or illegal use, or risked harm to the Service or other users. Upon termination, your right to use the Service will immediately cease.
These Terms are governed by the laws of the State of Delaware, USA (without regard to its conflict of law rules). You agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute arising out of or relating to these Terms or the Service. (You can change the state here if your business is registered elsewhere.)
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after the updated Terms become effective means you accept the changes.
